Welcome to Curated Care LLC! These Terms of Service ("Terms") govern your use of the curated-care.com website and our telehealth services (collectively, the "Service") provided by Curated Care LLC ("Curated Care," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

1. Service Description

Curated Care LLC provides telehealth services, including but not limited to, consultations, diagnosis, treatment, and prescription services for NAD+ therapy, Testosterone Replacement Therapy (TRT), and Hormone Replacement Therapy (HRT), as well as information about these therapies and related wellness products. Our services are delivered remotely via secure electronic communication technologies.

IMPORTANT: OUR SERVICE IS NOT FOR EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, PLEASE CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

2. Eligibility

To use our Service, you must be at least 18 years old and reside in a U.S. state where we operate and where telehealth services are legally permitted for your condition. By using our Service, you represent and warrant that you meet these eligibility requirements. Some services may have additional age or health-related eligibility criteria.

3. Patient Accounts and Responsibilities

a. Account Creation

You may need to register for an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.

b. Accurate Information

You are responsible for providing truthful, accurate, and complete health and personal information to our healthcare providers. Failure to do so may negatively impact your care and could result in harm. We are not liable for any injury or negative outcome resulting from your provision of inaccurate or incomplete information.

c. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To impersonate or attempt to impersonate Curated Care, a Curated Care employee, another user, or any other person or entity.

4. Telehealth Services Consent

Telehealth involves the use of electronic communications to enable healthcare providers at different locations to share individual patient medical information for the purpose of improving patient care. By using our Service, you consent to receive telehealth services from our affiliated healthcare providers. You understand and agree to the following:

  • Telehealth may have potential benefits, including easier access to care and the convenience of not having to travel to a physical clinic.
  • Telehealth also has potential risks, including but not limited to, information transmission security risks, potential for misdiagnosis due to lack of in-person examination, and delays in medical evaluation or treatment due to deficiencies or failures of the technology.
  • You have the right to withhold or withdraw your consent to telehealth services at any time, without affecting your right to future care or treatment.
  • We will take reasonable steps to protect the confidentiality of your information, but no system can guarantee perfect security.
  • Your healthcare provider will explain your diagnosis and treatment options, and you will have an opportunity to ask questions.

5. Medical Advice Disclaimer

While our Service provides access to medical consultations and treatments, the general information provided on our website (e.g., blog posts, articles) is for informational purposes only and does not constitute medical advice. You should always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on our website.

6. Prescriptions

Our licensed healthcare providers may issue prescriptions based on their professional judgment and your medical needs. We do not guarantee that a prescription will be written. Prescriptions are fulfilled by partner pharmacies. You are responsible for the cost of your prescriptions. We are not responsible for any pharmacy errors or omissions.

7. Payment and Billing

You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. We use a third-party payment processor to bill you through a payment account linked to your account on the Service. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms.

8. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Curated Care LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally permitted through the Service's functionality.

9. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service.

10. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CURATED CARE LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

NEITHER CURATED CARE LLC NOR ANY PERSON ASSOCIATED WITH CURATED CARE LLC MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER CURATED CARE LLC NOR ANYONE ASSOCIATED WITH CURATED CARE LLC REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CURATED CARE LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

13. Indemnification

You agree to defend, indemnify, and hold harmless Curated Care LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Service.

14. Governing Law and Jurisdiction

All matters relating to the Service and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Wyoming without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wyoming, in each case located in Sheridan County.

15. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

16. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Curated Care LLC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
